maybe a little bit late and I don't know if anyone has come up with this idea but let me say just one thing.
Music is Art! In Ancient Greek, everybody was sharing for God's sake (I may sound like torrent-freak fool but it's true). Artists should share their work. You might say "then from where the hell they get the money to live?" In the past, artists, musicians were highly acclaimed and taken by the royal families. We may not have royal families now but still there are alternative ways of figuring this out:
1- Concertsss!! (like the Blach Mages, Play!, Orchestral Game Concert, etc..)
2- Praise and support from the government!!
3- Musicianship - education
We should not forget that these music pieces are used in VIDEO Games!! What are they for?
Anyway, there's no need to argue at this point. Guess it's just too late! Whoever loomed at this, thank you for finishing this argument...

I don't understand how anyone can even try to justify that downloading mp3s is legal under Fair Use provisions. It's one thing to be protected under Fair Use for using a copyrighted work for educational purposes or for review or similar purposes. But mass distribution is entirely different and is not protected under Fair Use.
Fair Use is evaluated by these four factors:
the purpose and character of the use
the nature of the copyrighted work
the amount and substantiality of copying
the market effect
The fourth factor, the effect on the market, is the most important factor when determining whether a copyrighted work has been infringed upon.
The quoted text below establishes that the court found that it affects the market. This makes it pretty clear that the courts have ruled against downloading mp3s and have established a legal precedent.
Question: Does the fair use doctrine permit users to download MP3 files to make temporary copies of copyrighted sound recordings to "sample" the music before deciding whether to purchase the recording?
Answer: No. The courts that have considered this issue thus far have held that allowing users to download a full, free, and permanent copy of the copyrighted recording would be a commercial use that would adversely affect the copyright owners' market for their work. The Napster court observed that "even if sampling enhanced the audio CD sales of the recording, the benefit to the copyright owner is not a sufficient indication of fair use." Further, the court held, even if the sampling benefited the copyright owner's audio CD sales, the copyright owner still enjoyed the right to develop alternative markets, such as the digital download market, and not to have such market usurped from them.

video game music that has never, and will never, be released commercially is an entirely different case from mp3s of regular, commercially available music.
this was all covered by me in numerous posts in this thead if you'd actually bothered to read it.
and GH has been operating for a year and is more popular than ever. we're not going anywhere for legal reasons.

What you say is true, however you didn't understand my point at all.
I delved into this matter in a much broader sense. You see, "art" (including video game music) should not be any use of marketing and contaminated by money. Under today's circumstances, what you is quite logical. If you look at it in a philosophical manner, what I say may also sound logical. Also, what Sarah says is totally true. Anyway, don't me wrong. I am quite sensitive about these. This is about a problem in our society. Other than that, you're right(AND I mean it!).

we recieved a cease and desist letter from square-enix and were essentially forced to remove them.
if you're discontent with this (as many people are), we urge you to contact them. emails work, but regular letters are a lot more effective.
how come ffdream and blue laguna managed to have them?

O.K., I've read the first 4-5 pages of this thread, and it's clear that "Trance Kuja" should be banned. He's clearly biting that hand that feeds his FF craving. Showing disrespect to the webmaster and the thousands of people on the forum. Just a suggestion.

wow for people who don't pay for taking other's work, everyone here sure is defensive.
End of the day, square did the right thing. They can do anything they want with music THEY created and no one anywhere has a 'right' to work that doesn't belong to them. You steal music and then act like the victims. It's the 21st century, anyone can get anything from anywhere legally and fairly. The only way they don't is cause their lazy, impatient or cheap. If you can't afford it, you save up like everyone else.
You're stealing music, end of story. Your not a victim and your not doing the right thing in any way. Atleast have the honesty to NOT justify yourself and convince yourself your doing something that's okay. It's not.
(Oh and Trance Kuja, if your still checking this, I'm completely with you. 99% of the ones swearing and name calling on these forums are the ones who have run out of arguments and it couldn't be truer here. Hope your not taking it to heart.
And everybody else: it a conversation. Trance Kuja's 14, there's no need to be swearing like that, let alone to a kid. Chill out)
