Looks like this was also included in a FSM box set somewhere. There is a nice bit from the liner notes posted here:

His rip is an LP it has nothing to do with FSM.
I have this as well 10 tracks although it’s not a vinyl rip.

Yes but the FSM release is a re-issue of the vinyl rip, or so I got from the liner notes.

This is where the policy gets muddy I suppose – I hadn’t realised it had been released by anyone on CD so thought it was safe.

Guess I should leave it to a moderator to make the decision.

The Mods don’t necessarily check. So, I suppose make your own decision. Ask Jessie if you want. If this is a rip of the original vinyl, then that is not FSM, technically. A rip of the re-release would be, but I don’t see how a label can claim ownership on other label’s releases retroactively, IMHO.
