I think the ESRB ratings are pretty much irrelevant as well. Of course there are some games that deserve the ratings given to them, but there are others who don’t. Of course I don’t have actual game titles yet, but I still know I don’t care much for the ratings.
…also, in the event they were without certification, the media would eat the games industry alive for every manhunt incident – Rockstar would have no leg to stand on and probably get masacred in the process. Thus, no certification would lead to an ironic decrease in violent games, because nobody would want to piss off the media because some crazy guy bought their game and acted it out. Though the responsibility either way is in the hands of the person who gave the kid the game, without certification, they can plea that they had no real way of knowing that the game was appropriate for the child they were buying for.
I hope that makes it clearer for you.
In summary: Saying ratings are stupid is just wrong.

Mind you, ratings are a bit annoying in Aus at the moment – because we don’t have an 18+ rating in video games yet (our highest is MA15+), Leisure Suit Larry: Magna Cum Laude has been denied release in Australia 🙁
