I'm pretty sure you would be hard-pushed to be able to tell the difference between an MP3 320kps version of something from its lossless original - particularly, if it was transcoded directly using that.

Personally, if I could get MP3 128/160kps versions of stuff I'm after, I'd be chuffed to bits, so don't be greedy.

Just because something is in FLAC, that doesn't mean it's from a lossless source. Several of the tracks on the FLAC version of The Dark Knight for example are NOT lossless. The trilogy is in as good quality as it's going to be for a long time.
